Article 1: object
These General Terms and Conditions of Sale (hereinafter "GTC") define the terms and conditions under which the company TARDY PARIS (hereinafter "TARDY") markets sunglasses and all related products through of the TARDY website under the URL: http://tardyeyewear.com (hereinafter the "Site").
TARDY reserves the right to modify these T&Cs at any time, without notice, it being agreed that such modifications will not apply to orders previously accepted and confirmed by TARDY. Thus, the GCS, which can be updated and modified at any time, it is your responsibility to consult them regularly.
Any reservation or order placed on the Site implies full and complete acceptance of these GCS and payment of sums due for orders made and confirmed.
Article 2 - Price
The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the TARDY company. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.
All orders, whatever their origin, are payable in euros.
TARDY reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of validation of the order.
The products remain the property of the TARDY company until full payment of the price. However, as soon as you take physical possession of the products ordered, the risk of loss or damage and custody of the products are transferred to you.
Article 3 - Orders
You can place an order on the Site.
The contractual information (essential characteristics of the products, prices, etc.) is presented in French and will be subject to confirmation at the latest when your order is validated.
TARDY reserves the right not to register a payment, and not to confirm an order, in particular in the event of a supply problem or in the event of difficulty concerning the order received.

Article 4 - Validation of your order
Any order appearing on the Site assumes adherence to these T&Cs. Any order confirmation entails your full and complete acceptance of these T&Cs, without exception or reservation.
All the data provided and the recorded confirmation will constitute proof of the transaction. You are responsible for the data provided; TARDY cannot be held liable for failures due to incorrect information that you have provided.
A summary of the information of your order and these T&Cs, as well as the withdrawal form, will be sent to you in PDF format via the e-mail address confirming your order.

Article 5 - Payment
The fact of validating your order implies for you the obligation to pay the indicated price.
Payment for your purchases is made by credit card using the secure STRIPE system. The card is debited only when the order is dispatched. In case of split deliveries, only the products shipped will be debited.

Article 6 - Withdrawal
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay a penalty.
You can inform us of your decision to withdraw by sending us any other statement, unambiguous, expressing your desire to withdraw;
Returns must be made within 14 days of exercising your right of withdrawal and in their original and complete condition (accessories, instructions, etc.). Your liability may be incurred in the event of depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of these goods.
Return costs are your responsibility.
In the event of exercise of the right of withdrawal, TARDY will reimburse the sums paid (with the exception of the delivery costs in the event that you have chosen the non-standard delivery method), within 14 days from from the recovery of the goods or from receipt of the proof of the dispatch of these goods (the date retained being that of the first of these facts). TARDY will make this refund using the same means of payment used when placing the order.

Article 7- Availability
Our products are offered as long as they are visible on the Site within the limits of available stocks. For non-stocked products, our offers are valid subject to availability from our suppliers.
In case of unavailability of product after placing your order, we will inform you as soon as possible by sending an e-mail to the address indicated when ordering. Your order will be automatically canceled and no bank debit will be made.
The Site is not intended to sell its products in large quantities. Consequently, the TARDY company reserves the right to refuse orders for 10 identical items.

Article 8 - Delivery
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.
In case of late shipment, an email will be sent to you to inform you of any consequences on the delivery time indicated to you.
In accordance with the legal provisions, in the event of late delivery, you benefit from the possibility of canceling the order after having sent us a registered letter with acknowledgment of receipt enjoining us to deliver the products within a period indicated in accordance with the conditions and methods defined in article L.138-2 of the consumer code.
In the event of deliveries by a carrier, TARDY cannot be held responsible in the event of a delay in delivery due exclusively to the unavailability of the customer after several appointment proposals.

Article 9 – Legal guarantees
All our products benefit from the legal guarantee of conformity of articles L. 211-4 to L. 211-13 of the consumer code and the guarantee against hidden defects, provided for in articles 1641 and following of the civil code.
In the event of a lack of conformity within the meaning of Article L.211-4 of the Consumer Code, the product may be returned and exchanged (or refunded if replacement is impossible) within a period of 2 years from delivery of the product. In the event of a hidden defect in the product within the meaning of article 1641 of the Civil Code, you have the choice between returning the item and having the price refunded to you, or keeping the item and having part of the price refunded to you. This action must then be exercised within 2 years from the discovery of the defect affecting the product.
The consumer must provide proof of a hidden defect, prior to the sale and preventing the use of the product.
The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
After the deadlines for recourse in terms of the legal guarantee of conformity and the guarantee of hidden defects, the articles will be deemed to be compliant and free from any apparent or hidden defect and no complaint can be validly accepted by TARDY.
TARDY cannot however be held responsible for the misuse and/or intensive use of the items that the customer may make of them.
The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions, etc.). The shipping costs will be reimbursed to you on the basis of the price invoiced and the return costs will be reimbursed to you on presentation of the supporting documents.
The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in article 6.
Article 10 - Liability
TARDY is automatically liable to the customer for the proper performance of the obligations resulting from the contract. However, TARDY cannot be held liable if the non-performance or poor performance of the contract is attributable either to the customer (example: misuse of the product purchased), or to the unforeseeable and insurmountable fact of a third party unrelated to the supply of the products provided. to the contract, or to a case of force majeure.
The products offered comply with the French legislation in force. Nor can TARDY be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.
Finally, TARDY cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular (and without this list being exhaustive) a break in service, an external intrusion or the presence of computer viruses.

Article 11 - Applicable law in the event of disputes
The language of this contract is French. These conditions of sale are exclusively subject to French law.

Article 12 - Intellectual property
All elements of the Site are and remain the exclusive intellectual property of TARDY. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site whether software, visual or sound. Any simple or hypertext link is strictly prohibited without having obtained the prior written consent of TARDY.

Article 13 - Personal data

The Customer is informed and accepts that his personal data may be collected on the Site and used by TARDY, which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 relating on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or " GDPR”).
TARDY undertakes to protect and ensure the security and confidentiality of its Customers' personal data in accordance with the GDPR, in particular by taking all necessary precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties.
In particular, Customers' personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the GDPR, intervene and contribute directly to the management of orders and for whom it is absolutely necessary to access the data. personal information provided by the Customer when creating and using his account (identity, postal address, telephone number, email address). Subcontractors may only act on instructions from TARDY.
Customers' personal data is collected for the following purposes:
the management of orders and relations with Customers;
Customer information relating to offers and commercial information related to the brand;
strengthening and improving the communication of the site and the brand by sending, in particular, newsletters and special offers according to the Customer's preferences noted on the site;
improving and personalizing the services offered to Customers; and
compliance with legal and regulatory obligations.
The Customer's personal data is only kept for the duration strictly necessary for the purposes previously explained.
In accordance with the GDPR, the Customer has a right of access, rectification and opposition to personal data concerning him (hereinafter the "Computer Rights and Freedoms").
To exercise one or more of the Computer Rights and Freedoms, the Customer must send a request by email or by post to TARDY's customer service, by writing an email to info@tardyeyewear.com or by writing to the following address indicating his last name, first name, e-mail address and customer references: Tardy Paris, 30 Rue Montgallet, 75012 Paris.
Each request must be signed and accompanied by a photocopy of an identity document bearing the Customer's signature and specifying the reply address.
The response to the request made on the basis of one or more Computer Rights and Freedoms will be sent within 1 month of receipt of the request.
The Client may communicate to TARDY specific instructions in which he or she defines the way in which he or she intends to exercise, after his or her death, the Computer Rights and Freedoms in accordance with the GDPR.
TARDY is likely to send customers information relating to branded items and commercial offers by post, email, text message, telephone or via all the web spaces run by TARDY on social networks, subject to prior acceptance.
The customer has the option at any time to oppose these commercial prospecting mailings free of charge, by clicking on the “unsubscribe” link appearing in each commercial email, or by making the request via an email to info@tardyeyewear. com
Article 14 - Archiving Proof
TARDY will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the civil code.
TARDY's computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
